Please read these Terms and Conditions carefully before using Our Service.
Interpretation and Definitions
Interpretation
Words with initial capital letters have meanings defined under the following conditions. The definitions apply regardless of whether they appear in singular or plural.
Definitions
- Affiliate: An entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest, or voting securities.
- Country: South Africa.
- Company: Bidsstack (“the Company”, “We”, “Us”, or “Our”).
- Device: Any device that can access the Service, such as a computer, cellphone, or tablet.
- Service: The Bidsstack website and related services.
- Terms and Conditions: These Terms and Conditions that form the entire agreement between You and the Company.
- Third-party Social Media Service: Services or content provided by third parties and available through the Service.
- Website: Bidsstack, accessible at https://bidsstack.com.
- You: The individual, company, or other legal entity accessing or using the Service.
Acknowledgment
These Terms govern the use of this Service and establish the agreement between You and the Company. Your access to and use of the Service is conditioned on Your acceptance of these Terms and our Privacy Policy.
By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, You must not access the Service. You confirm that You are over 18 years old.
Free Access and Starter Features
Tender summaries, published contact details, and special conditions are available without a paid plan. Starter adds access to tender documents, briefing information, alerts, closed tender history, and awarded tender intelligence. Individual listings may not include every type of information or document, and linked documents depend on the originating publisher.
Prices and Payment Options
Starter is available through two payment options with the same plan features. Prices are in South African rand (ZAR):
- 30-day pass: R300 paid once for 30 days of Starter access from successful payment. The pass expires automatically and does not create a recurring subscription. You must make a new purchase if You want access after it expires.
- Monthly subscription: R300 per month, charged automatically through Paystack until cancelled. Access continues for the remainder of the paid billing period after cancellation.
Review the selected payment option and price at checkout and pricing before paying. There is no free trial. Both payment options include our 30-day money-back guarantee.
Activation, Cancellation, and Refunds
Paid access is linked to Your Bidsstack account and activates after payment confirmation is received and processed. Confirmation can be delayed; a payment return page alone is not proof that access is active. See our Service Delivery Policy for help with activation.
The once-off pass does not need to be cancelled. For monthly subscription cancellation and refund requests, see our Cancellation Policy and Refund Policy.
Nothing in these Terms or the linked policies excludes or limits rights or remedies that cannot be excluded under applicable law, including the South African Consumer Protection Act.
Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. We strongly recommend reviewing their terms and privacy policies.
Termination
We may terminate or suspend Your access immediately, without prior notice or liability, for any reason, including if You breach these Terms. Upon termination, Your right to use the Service will cease immediately.
Limitation of Liability
To the maximum extent permitted by law, the Company and its suppliers shall not be liable for indirect, incidental, special, or consequential damages (including loss of profits, data, or privacy) arising from or related to Your use or inability to use the Service. Total liability is limited to the amount You paid through the Service or $100 USD if no purchases were made.
“AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee uninterrupted operation, error correction, or compatibility with other systems. Some jurisdictions may not allow certain exclusions, so these limitations may not apply to You.
Governing Law
These Terms are governed by the laws of South Africa, without regard to its conflict of law rules. Your use of the Service may also be subject to local, national, or international laws.
Disputes Resolution
If You have any dispute or concern, You agree to attempt to resolve it informally by contacting the Company first.
For European Union (EU) Users
If You are an EU consumer, You will benefit from any mandatory provisions of the law of the country in which You are a resident.
United States Legal Compliance
You represent that (i) You are not located in a country subject to U.S. government embargo or designated as a “terrorist supporting” country, and (ii) You are not on any U.S. government list of prohibited or restricted parties.
Severability and Waiver
Severability
If any provision is deemed unenforceable, it will be modified to achieve its intent as closely as possible under applicable law, and the remaining provisions will remain in effect.
Waiver
Failure to enforce any provision does not constitute a waiver of that provision or any other provision.
Translation Interpretation
These Terms may have been translated. In case of dispute, the original English version shall prevail.
Changes to These Terms and Conditions
We reserve the right to modify or replace these Terms at our discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice before new terms take effect. By continuing to access or use our Service after changes, You agree to be bound by the revised terms.
